GENERAL TERMS AND CONDITIONS OF CONTRACT

PURPOSE

These General Conditions regulate the access, contracting, and use of the service offered by Storage & Fly S.L., consisting of:

  • Service of vehicle pick-up, storage, and delivery at the airport
  • Subscription system that allows managing bookings associated with the service

Contracting implies full acceptance of these conditions.

USER

The user declares:

  • To be over 18 years old
  • To have the legal capacity to contract
  • To provide true and updated data

The user will be responsible for the proper use of the service.

SERVICE OPERATION

The service is based on an active subscription model, which allows:

  • Access to the booking system
  • Use of the vehicle pick-up, storage, and delivery service at the airport

Each booking corresponds to a single vehicle.

BOOKING PROCESS

  • Bookings are made via the website form
  • All required data must be completed
  • The system will generate a locator number
  • Bookings must be made at least 48 hours in advance

Confirmation implies acceptance of the service.

SERVICE PROVISION

The service consists of the pick-up, transfer, storage, and subsequent delivery of the user’s vehicle.

Vehicle delivery - start of service

  • The user must bring their vehicle to the agreed airport location
  • They must identify themselves and show their booking to Storage & Fly staff
  • After proper identification, they will hand over the vehicle and its keys to the staff
  • Additionally, staff may record the vehicle’s condition at that time using photographs

Vehicle collection - end of service

  • The user must request vehicle delivery at least 48 hours in advance
  • The vehicle specified in said request will be delivered to the agreed airport location
  • To collect the vehicle, the user must present the booking confirmation together with a valid identification document
  • If such documentation is not provided, the user must sufficiently prove ownership of or authorization to collect the vehicle
  • Storage & Fly S.L. shall not be liable for fraudulent use of forged or misleading documentation
  • Any incident or complaint must be reported immediately upon vehicle collection and before leaving the premises

Additional Operating Conditions

  • Out-of-hours services may incur an additional cost
  • The user is responsible for informing of changes to their flight or plans
  • The user must arrive at least 10 minutes before the agreed time
  • Storage & Fly S.L. shall not be liable for missed flights caused by delays, traffic conditions, airport incidents or the user’s lack of punctuality
  • The vehicle may be moved within or between Storage & Fly S.L. facilities for logistical, operational or space optimisation purposes
  • Delivery of the vehicle keys, or a copy thereof, is mandatory for the provision of the service
  • The company reserves the right to refuse vehicles due to their size, condition or any circumstance affecting the proper provision of the service
  • Additional charges may apply to oversized or poorly maintained vehicles
  • Availability of covered parking spaces during the first 10 days of storage is not guaranteed

AUTHORIZED DRIVERS

  • Only the user and persons registered as authorized for that vehicle may collect the vehicle
  • To add authorized drivers, this must be done 48 hours in advance
  • The authorization process can only be initiated by the user
  • You will be asked to provide the authorized person’s full name and identification

No vehicle will be delivered without identity verification

PRICES AND PAYMENTS

  • Prices are indicated in euros (€) and include applicable taxes
  • Subscription payment is mandatory to confirm the contract
  • Vehicle collection will not be permitted if there are outstanding payments
  • Storage & Fly S.L. may retain the vehicle until all outstanding amounts relating to the service have been paid in full
  • All prices include applicable taxes and may be modified at any time prior to contracting the service
  • Services provided outside standard operating hours may incur additional surcharges published on the website

DURATION, RENEWAL, AND CANCELLATION

Nature of the service

  • The service operates under a subscription model that grants the right of use during the contracted period
  • This subscription must remain active to drop off or collect vehicles at Storage & Fly

Start of service and right of withdrawal

  • By completing the contract, the user expressly requests the immediate start of the service
  • Consequently, and in accordance with current regulations, the user loses their right of withdrawal once the service has started.

Duration and renewal

  • The service subscription will have the duration contracted at the time of purchase
  • The subscription may be renewed to continue using the service
  • If not renewed, access to make new bookings will be lost

Stored vehicles

If the user has a vehicle stored and their subscription ends:

  • They must renew the subscription obligatorily
  • During the subscription’s inactive period, current rates will apply.

The vehicle may be collected after renewal.

Cancellation

  • The user may cancel the subscription at any time
  • Cancellation does not imply a refund for the period already paid
  • The service will remain active and can continue to be enjoyed until the end of the contract

Unused bookings

Bookings made and not used will not be refundable, unless legally required.

Abandoned Vehicles

A vehicle may be considered potentially abandoned if it remains parked for more than 10 months without communication from the owner or without payment of outstanding amounts.

In such cases, Storage & Fly S.L. may:

  • Attempt to contact the vehicle owner
  • Retain the vehicle until outstanding amounts have been fully paid
  • Notify the competent authorities
  • Initiate any legally permitted procedures for removal, auction or deregistration of the vehicle

Any costs arising from such circumstances shall be borne by the vehicle owner.

LIABILITY

Liability of the Parking Operator

In accordance with Spanish Law 40/2002 of 14 November regulating vehicle parking contracts, Storage & Fly S.L. shall be liable for damages or losses affecting the vehicle or the user during the provision of the service, except where such damages are caused by third parties.

This includes, among others:

  • Personal injuries resulting from defective or unsafe facilities
  • Damage caused by structural failures, flooding, burst pipes or falling objects
  • Theft or unlawful removal of the vehicle or integrated vehicle components

The following are excluded from liability:

  • Damage caused by weather conditions in uncovered parking areas
  • Non-fixed objects or accessories left inside the vehicle
  • Damage caused by animals, including rats, rodents or similar animals present on the premises
  • Mechanical breakdowns or technical malfunctions inherent to the vehicle

Likewise, the company does not guarantee the continuous availability of the website or the absence of technical errors.

Vehicle Condition and Personal Belongings

  • Storage & Fly S.L. does not carry out mechanical inspections prior to vehicle storage
  • The user is responsible for documenting any pre-existing damage with photographs at the time of handover
  • Claims relating to minor superficial damage under 5 cm shall not be accepted unless there is clear evidence directly linking such damage to the service provided
  • The user must remove all non-fixed items from the vehicle before delivery
  • The company shall not be liable for the loss, theft or damage of personal belongings, documents, electronic devices or protective covers left inside the vehicle

Insurance and Roadworthiness Inspection

The user guarantees that the vehicle has at all times:

  • Valid compulsory motor insurance
  • A valid roadworthiness inspection certificate (MOT/ITV or equivalent), where legally required

Failing this, Storage & Fly S.L. shall not assume any responsibility for repairs, internal vehicle movements or transportation of the vehicle.

SERVICE AVAILABILITY

The service may be affected by force majeure, technical incidents, or external circumstances, without giving rise to any right to compensation.

Additional services offered by Storage & Fly S.L., including cleaning services or other complementary services, may be modified or limited due to operational, technical or vehicle-related circumstances.

DATA PROTECTION

Personal data will be processed in accordance with:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).
  • Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights (LOPD-GDD).
  • Royal Decree 1720/2007, of December 21, approving the Regulation implementing Organic Law 15/1999, of December 13, on Personal Data Protection (RDLOPD).
  • Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI-CE).

COMMUNICATIONS

Communications can be made by the following means:

  • Email
  • Phone
  • Whatsapp
  • Web form

The user accepts any of these methods as valid.

MODIFICATIONS

Storage & Fly S.L. reserves the right to modify these conditions at any time, with those published at the time of contracting being applicable.

LEGISLATION AND JURISDICTION

These conditions are governed by Spanish law. For the resolution of any controversy that may arise in relation to the interpretation, fulfillment, or execution of this contract, the parties expressly submit to the jurisdiction of the Courts of Palma de Mallorca (Illes Balears), expressly waiving any other jurisdiction, without prejudice to the rights that consumer and user protection regulations grant to the consumer to appear before the courts of their domicile.

COMPLAINTS

The user may submit complaints by contacting Storage & Fly S.L. through any of the means indicated in this document.

Storage & Fly S.L. provides users with Official Complaint Forms, which can be requested by email at info@storageandfly.com. Once the request is received, the company will provide the corresponding form as soon as possible.

In the event of discrepancies between translated versions of these Terms and Conditions, the Spanish version shall prevail
